Welcome to Cleancare. Your use of this website and store, including all related information, content, features, tools, products and services (the “Services”), is conditional upon your acceptance of and compliance with these Terms of Service. Please read them carefully before placing an order.

The Services are operated by Maruti Cleancare Pty Ltd (ABN 94 648 346 954), trading as Cleancare (“Cleancare,” “we,” “us” or “our”), and are powered by Shopify. By accessing or using the Services, you agree to be bound by these Terms of Service and by our Privacy Policy, Shipping Policy and Refund & Return Policy, which are incorporated by reference. If you do not agree, please do not use the Services. We reserve the right to amend these Terms of Service at any time without notice. Your continued use of the Services after any amendment takes effect constitutes your agreement to be bound by the Terms of Service as amended.

Eligibility

By using the Services, you confirm that you are able to form a legally binding contract and are at least the age of majority in your state or territory of residence, or that you are using the Services with the consent and supervision of a parent or guardian. You agree to provide accurate and complete information when you place an order or create an account.

Your Account

You may need to create an account to access certain features or to make a purchase. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. We highly recommend that you do not share your username, password or other access details with anyone else. Please notify us immediately if you suspect any unauthorised use of your account.

Products & Availability

All products are offered subject to availability, and we may limit, modify or discontinue any product at any time without notice. If a product you have ordered is unavailable, a customer service representative will contact you regarding an alternative selection. We make every effort to display product descriptions, images and specifications as accurately as possible; however, we do not warrant that such content is always complete, current or error-free.

Pricing & GST

GST (Goods and Services Tax) of 10% is included in all our prices. All prices stated are in Australian dollars (AUD). Prices of products and other charges displayed on the Services are current at the time of issue but are subject to change at any time without notice. We reserve the right to correct any pricing errors, even after an order has been submitted.

Payment

Cleancare accepts the following methods of payment:

• Credit card online (MasterCard, VISA)
• Credit card over the phone (MasterCard, VISA, American Express, Diners Club)

Cleancare does not convert your total into any currency other than Australian dollars. We will charge your card in AUD and your card provider will convert the amount for you. Please note that American Express and Diners Club payments incur a 4% surcharge. We reserve the right to refuse or cancel any order where we reasonably suspect fraud, an unauthorised or unlawful transaction, or a pricing or product error.

Orders

When you place an order, you are making an offer to purchase the relevant products subject to these Terms of Service. We may accept or decline your order at our discretion. A contract is formed only once we confirm acceptance of your order. Order confirmation and dispatch details will be sent to the email address you provide.

Promotion Codes

From time to time, Cleancare may offer customers promotion codes for various discount amounts. Customers may first need to purchase a minimum value of products to qualify. Promotion codes:

• Can only be redeemed on the Cleancare website;
• Can be used any number of times within the promotion dates specified in the relevant promotion terms;
• Are credited to your order at checkout when redeemed;
• Expire on the date shown in the relevant promotion terms;
• Cannot be exchanged or redeemed for cash, or redeemed in any retail store;
• Cannot be replaced if misplaced.

Shipping & Returns

Delivery of your order is governed by our Shipping Policy, and returns, refunds and exchanges are governed by our Refund & Return Policy. Please review both before placing an order.

Acceptable Use

When using the Services, you agree that you will not:

• Use the Services for any unlawful purpose or in breach of any applicable law or regulation;
• Infringe our intellectual property rights or those of any third party;
• Upload or transmit any viruses, malware or other harmful code;
• Attempt to gain unauthorised access to, interfere with, or disrupt the Services or any associated systems or networks;
• Use any automated means to scrape, harvest or collect information or content from the Services without our prior written consent;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Use the Services in any way that could damage, disable or impair them, or interfere with any other party’s use of them.

Intellectual Property

All content on the Services — including text, graphics, logos, images, product descriptions, layout and design — is owned by or licensed to Cleancare and is protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to access and use the Services for your personal, non-commercial purposes and to make legitimate purchases. You may not reproduce, distribute, modify, republish or otherwise exploit any content from the Services without our prior written permission.

Third-Party Links

The Services may contain links to websites or platforms operated by third parties. We do not control and are not responsible for the content, privacy practices or security of such sites. The inclusion of any link does not imply our endorsement. You access third-party sites at your own risk and should review their terms and policies.

Disclaimer of Warranties

To the maximum extent permitted by law, and subject to the consumer guarantees referred to below, the Services and products are provided on an “as is” and “as available” basis. We do not warrant that the Services will be uninterrupted, secure, or free of errors, viruses or other harmful components.

Australian Consumer Law

Nothing in these Terms of Service excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Limitation of Liability

To the extent permitted by law, Cleancare will not be liable for any indirect, incidental, special or consequential loss arising out of or in connection with your use of the Services. Where our liability for a breach of a non-excludable consumer guarantee cannot be excluded but can be limited, our liability is limited, at our option, to the resupply of the goods or the payment of the cost of resupplying the goods.

Indemnification

You agree to indemnify and hold harmless Cleancare and its directors, officers, employees and agents from and against any claims, liabilities, damages, losses and expenses arising out of your breach of these Terms of Service or your misuse of the Services, to the extent permitted by law.

Governing Law

These Terms of Service are governed by the laws of the State of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria.

General

If any provision of these Terms of Service is found to be unlawful or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision does not constitute a waiver of that right or provision. These Terms of Service, together with the policies referred to above, constitute the entire agreement between you and Cleancare regarding your use of the Services.

Changes to These Terms

We may update these Terms of Service from time to time to reflect changes to our practices or for operational, legal or regulatory reasons. We will post the revised Terms on this website and update the “Last updated” date above. Your continued use of the Services after any change constitutes your acceptance of the revised Terms.
